Politics: The 4T moves to further restrict the power and independence of the judicial system

In the ongoing battle to defend the role and independence of the judicial branch of government, the latest front involves the legislative decision to amend the Amparo Law. Those in favor of reforming the Amparo Law charge that it has been used to shield the rich and powerful, especially high-end tax debtors, from legal sanctions and to prolong the implementation of corresponding sanctions for years, if not decades. But amparos, a type of protective injunction, have also protected common citizens from abuses of authority.

President Sheinbaum, considered the architect and driving force behind the recent reform, argues that it will curb abuses by the rich and powerful, but leave intact citizen protection. On a political level, however, the opposition charges that the reform seeks to continue the 4T’s efforts to concentrate increasingly greater power in the hands of the executive branch, in this case by further weakening the Judiciary. Business circles are also opposed to the reform. The Mexican Employers’ Confederation (COPARMEX) warns that the reform limits legal protection for companies. Other criticisms include concerns that the amended legislation violates the principle of the progressive development of human rights recognized in the Constitution by limiting the protection that can be granted in amparo legal proceedings.
