STF blocks Bolsonaro appointee to Federal Police

The decision of the Minister of the Federal Supreme Court (STF), Alexandre de Moraes, to suspend the appointment of Alexandre Ramagem to the top position at the Federal Police´s (PF) represents a setback for President Jair Bolsonaro, who had chosen him to replace Maurício Valeixo.

In a preliminary decision, Moraes accepted the case filed by the PDT against the appointment of Ramagem. In his decision, the STF minister cited the accusations made by former Minister Sergio Moro to argue that there are signs of deviation in purpose in the choice of Alexandre Ragagem, and that it “is non-compliant with the constitutional principles of impersonality, morality and public interest."

Although he could appeal the decision to the plenary of the STF, President Jair Bolsonaro decided to cancel the appointment of Alexandre Ramagem to the PF general directorate and his resignation as the head of the Brazilian Intelligence Agency (ABIN). Therefore, Ramagem returns to the command of ABIN.

With the revoked appointment of Alexandre Ramagem, the case filed by the PDT, which had been accepted by Minister Alexandre de Moraes, loses effect. From now, Jair Bolsonaro will work to find a new name for the PF command. Until this decision, the position of director general will remain vacant.

Instead of appealing the Alexandre de Moraes preliminary decision, Bolsonaro opted for a “Plan B” to avoid a clash with the Supreme Court after Minister Celso de Mello accepted yesterday the request for an investigation into the allegations made by Moro against the President of the Republic. The assessment is that, even if he appealed against Alexandre de Moraes’ decision, Bolsonaro would be defeated in the plenary.
